Amazon & Ebooks and Pirates

This is something I've had my eye on the last few days, but you can follow this on twitter yourself:

In short, this fellow self-published a book. Then a pirate comes along and puts it up on Amazon pretending to be the author, selling it at $5 a copy. :)

What's most interesting of course is how Amazon is reacting to this. They still haven't removed the pirated copy, though they have (finally) let the original author put up a copy of his own. Gee, thx Amazon. ;)

That isn't just rude. It is criminal and actionable.

I was here about something along similar lines. I ran across an ebook site that lists one of my books and implies that they have had many sales. I don't have any sort of agreement with them, and I have not received any royalties. Further investigation indicated that they have taken extra money from customers' accounts. I'm looking for ideas as to which prosecutor to inform, here or where they are.
